QuokkaConnect Terms of Use
Effective date: October 19, 2026
These Terms of Use (the "Terms") govern access to and use of QuokkaConnect's website, mobile application, and related services (the "Service"). The Service is operated by Jack Cooksey and Alyssa Yang, co-owners and operators of QuokkaConnect ("QuokkaConnect," "we," "us," or "our"). Our mailing address is 2815 Guadalupe St, 406A, Austin, TX 78705. You can contact us at admin@quokkaconnect.com.
1. Accepting these Terms
By creating an account, accessing, or using the Service, you agree to these Terms and to the Privacy Policy at https://quokkaconnect.com/privacy. If you do not agree, do not use the Service.
2. Eligibility and service area
You must be at least 18 years old to create or use an account. We do not offer a parental-consent path for people under 18.
The Service's recommendations focus on events within the City of Austin, Texas, and may include events in the broader Austin metropolitan area. This describes recommendation availability, not a general requirement that a member live within those boundaries.
3. Accounts and account security
You must provide accurate account information, protect your account credentials, and promptly tell us at admin@quokkaconnect.com if you believe your account has been accessed without authorization. You are responsible for activity through your account to the extent permitted by law. You must verify your email address to use the Service, and may maintain only one account for yourself.
Signup includes a separate preselected checkbox for event and group matching emails. You may deselect it and still create an account, or turn those emails off at any time in Settings → Emails and continue using in-app matching. Verification and password-reset emails are separate from this preference. Each matching email links to that setting.
4. Community conduct
You may not use the Service to harass, threaten, discriminate against, defraud, impersonate, exploit, or endanger another person; to post unlawful, infringing, or deceptive material; to scrape, probe, disrupt, or reverse engineer the Service except where law does not permit that restriction; or to violate another person's privacy or rights.
These rules apply to invitations, in-person events, member-created plans, chat, and any other user-content feature that we make available. The Community & Safety Guidelines at https://quokkaconnect.com/community-guidelines are incorporated into these Terms.
5. Member content and feedback
You retain ownership of content you submit to the Service. You grant us the limited, non-exclusive, worldwide, royalty-free license needed to host, process, display to the intended Service audience, moderate, secure, and operate that content while you use the Service and after account deletion only as needed for backups, legal compliance, dispute handling, or de-identified or aggregated material, as described in the Privacy Policy. You represent that you own or are authorized to submit the content you provide.
If you voluntarily send us feedback, ideas, or suggestions about the Service (other than a review of the Service), you grant us a non-exclusive, worldwide, royalty-free right to use that feedback to operate, improve, and promote the Service without compensation or further permission. This does not limit rights you cannot waive by law.
6. Safety, reports, and moderation
We may review, remove, restrict, or preserve content; suspend or terminate accounts; and cooperate with lawful requests when we reasonably believe it is necessary to protect people, investigate suspected violations, operate the Service, or comply with law. We do not guarantee that we will review all content or prevent all harmful conduct.
Report safety or content concerns by emailing admin@quokkaconnect.com. Do not use the Service as a substitute for emergency services. Moderation decisions are final and are not subject to an internal appeal, except where applicable law requires otherwise. We do not promise a particular response time.
7. In-person activities and third-party events
The Service may help members discover, consider, or coordinate attendance at events and plans. Members decide for themselves whether to attend, participate, or interact with others. QuokkaConnect is not the organizer, owner, operator, or guarantor of a third-party venue, event, attendee, or member-created plan unless we explicitly state otherwise.
You are responsible for using reasonable judgment and following applicable laws, venue rules, ticket terms, and safety guidance. QuokkaConnect does not currently act as an event organizer, ticket seller, or fee collector. If that changes, we will update these Terms before offering the changed feature.
8. No professional or emergency services
The Service does not provide emergency, medical, legal, financial, mental-health, or other professional advice or services. If you need emergency assistance, call local emergency services.
9. Paid features and third-party purchases
QuokkaConnect does not charge members for access to the Service in v1. We may prioritize free events in recommendations, but some third-party events may have their own prices, tickets, fees, taxes, or terms.
Purchases from event organizers, venues, or other third parties are governed by those parties' terms, not these Terms.
10. Intellectual property
The Service, its software, branding, and original content are jointly owned by Jack Cooksey and Alyssa Yang under their pre-incorporation agreement, or by their licensors, and are protected by applicable law. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable right to use the Service for its intended purpose.
11. Changes, suspension, and termination
We may change, suspend, or discontinue the Service, or suspend or terminate access, as permitted by law. We may update these Terms by posting an updated version and changing the effective date. For a material change, we will provide notice by email before the change takes effect. Where applicable law requires your affirmative agreement to a material change, we will obtain it before the change applies to you. Otherwise, continued use after the effective date means you accept the updated Terms.
12. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE, EVENTS, PLANS, MEMBERS, CONTENT, OR RESULTS WILL BE SAFE, AVAILABLE, ACCURATE, SUITABLE, UNINTERRUPTED, OR ERROR-FREE.
Nothing in these Terms excludes or limits a warranty, remedy, or other right that cannot lawfully be excluded or limited.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, QUOKKACONNECT AND ITS CO-OWNERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF QUOKKACONNECT AND ITS CO-OWNERS FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO QUOKKACONNECT FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply to liability that cannot lawfully be limited, including liability for a party's fraud, willful misconduct, gross negligence, or bodily injury caused by that party where applicable law does not allow a limitation.
14. Indemnification
To the fullest extent permitted by law, you will indemnify and hold harmless QuokkaConnect, Jack Cooksey, Alyssa Yang, and their licensors and service providers from third-party claims, damages, liabilities, and reasonable costs (including reasonable attorneys' fees) arising from your unlawful content, your infringement of another person's rights, or your material violation of these Terms. We will promptly notify you of a covered claim, may control its defense, and will not settle it in a way that imposes a non-monetary obligation on you without your consent.
15. Governing law and disputes
Informal resolution
Before filing arbitration or a court claim, the party raising a dispute must send the other party a written notice describing the dispute and requested resolution. Notices to QuokkaConnect must be sent to admin@quokkaconnect.com. The parties will try in good faith to resolve the dispute for 30 days after notice.
Binding individual arbitration
THIS SECTION REQUIRES INDIVIDUAL ARBITRATION AND WAIVES THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE EXTENT PERMITTED BY LAW.
Except for eligible small-claims-court actions, either party may elect to resolve any dispute arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the demand is filed. The current rules and fee information are available from AAA. If AAA cannot or will not administer an arbitration, a court with jurisdiction may appoint a substitute administrator consistent with this agreement and applicable law. The arbitration may be conducted by video, on written submissions, or in person in the county where you live or in Travis County, Texas, as permitted by the AAA rules and applicable law.
You will not be required to pay more to begin an arbitration than you would pay to file a comparable claim in court. QuokkaConnect will pay the remaining AAA administrative and arbitrator fees to the extent required by the AAA rules or applicable law. The arbitrator may award the same individual remedies available in court, subject to these Terms and applicable law.
Opt-out
You may opt out of this arbitration agreement within 30 days after first accepting these Terms. To opt out, email admin@quokkaconnect.com with the subject line “Arbitration Opt-Out” and include your name, account email address, and a clear statement that you wish to opt out. Opting out does not affect the rest of these Terms.
Class-action waiver, governing law, and court venue
Disputes must be brought only on an individual basis, not as a plaintiff or class member in a class, collective, consolidated, or representative action, to the extent permitted by law. If this class-action waiver is found unenforceable for a particular claim, that claim may proceed in court rather than arbitration.
Texas law governs these Terms, without regard to conflict-of-law rules. If a claim may properly proceed in court, or a court proceeding is needed to enforce or challenge an arbitration agreement or award, the state or federal courts located in Travis County, Texas are the exclusive fallback venue, unless applicable law requires another venue.
